June 4, 1986 ORDER The Board has before it New England Coalition on Nuclear Pollution's (NECNP) Motion for Leave to File Answers to Interrogatories Out of Time dated May 20, 1986. We have also Applicants' Motion to Compel Response to Interrogatories dated May 16, 1986.1 The Board grants (1) NECNP's Motion for Leave to File Answers to Interrogatories Out of Time, and (2) so much of Applicants' Motion to Compel Response to Interrogatories dated May 16, 1986 as applies to NECNP. We find, however, that NECNP has obtained by indirection relief 1

NECNP had filed Motion for Reconsideration of Denial of Extention of Time for Answering Interrogatories dated May 14, 1986 and Applicants' Response to NECNP's Motion for Reconsideration of Denial of Time for Answering Interrogatories dated May 16, 1986 opposing NECNP's motion. A conflict appears in Applicants opposing the motion for reconsideration on the same day (May 16,1986)

Applicants' Motion to Compel Response to Interrogatories was filed.

In any event, the Board finds that the pleadings of both parties described above have been rendered moot by Applicants motion to compel, NECNP's motion of May 20, 1986, and the Board action in this Order.

it was once denied when it sought, without any acceptable justification an extension of time to file these responses to Applicants interrogatories. We find that such blatant disr'egard of this Soard's orders and directions will not be tolerated. Requests for relief of any kind from an order of this Board will be timely filed and document the grounds for the relief sough. a accordance with the provisions of 10 CFR $ 2.730(b). Mere recitation of what a counsel's work requirements are in other matters does not constitute gbod cause.

The NECNP Response to Applicants' Interrrogatories and Request for the Production of Documents and Motion for a Protective Order also filed May 20, 1985 is accepted only to extent of the interrogatories and request for production of documents. The Motion for a Protective Order will be ruled upon at a later date.
