Dear Mr. Campbell:

Enclosed for your information is the synopsis of the Nuclear Regulatory Commission (NRC) Office of Investigations (0I) completed report regarding alleged discrimination against a Nuclear Assessment Manager by an employee at the Brunswick Nuclear Plant, who filed a complaint with the U.S. Department of Labor.

01 determined that there was insufficient evidence to substantiate the allegation of discrimination. We plan no further action with regard to this matter. Should you have any questions concerning this letter, please contact us.

In accordance with Section 2.790 of the NRC's " Rule of Practice," Part 2.

SYNOPSIS On January 18, 1995, the Office of Investigations (01), U.S. . Nuclear Regulatory Commission, initiated an investigation of an alleged violation of 10 CFR 50.7, Employee Protection, by site management at Carolina Power and Light Company's (CP&L) Brunswick Nuclear Plant (BNP). A former Nuclear Assessment Department manager at BNP alleged that his employment with CP&L had been terminated because he had raised, and persisted with the proper correction of, a nuclear safety concern regarding slow operation of the control rods at BNP, Unit 2.

Based upon the evidence developed during the investigation, it is concluded that this allegation of discriminatory termination of employnent, as set forth l

under the provisions of 10 CFR 50.7, is unsubstantiated.
