,n I' NOTICE OF VIOLATION Commonwealth Edison Company Docket Nos. 50-373; 50-374 LaSalle County Statien Licenses No. NPF-11; NPF-18 During an NRC inspection conducted on August 24 through 28, 1992, a violation of NRC requirements was identified. in accordance with the " General Statement of Policy and Procedure for NRC Enforcement Action," 10 CFR Part 2, Appendix C (1992), the violation is listed below:

10 CFR 71.5 states, in part, that each licensee who transports licensed material outside of the confines of the plant shall comply with the applicable requirements of the regulations appropriate to the mode of transport of the Department of Transportation in 49 CFR Parts 170 through 189.

49 CFR 172.403(a) states, in part, that each package of radioactive material must be labeled as provided in this section.

49 CFR 172.403(g) states, in part, that the following applicable items of information must be entered in the blank s) aces on the RADIDACTIVE label by legible printing: contents (a listing of tie radionuclides in the package);

activity (curie amount); and the transport index, Contrary to the above, a package of radioactive spent resins was transported from the LaSalle Countv Station and was received at the Barnwell, S.C. burial site, on August 13, 992, bearing a RADI0 ACTIVE Yellow-III label that did not hve the required information of content, activity, and transport index entered in the blank spaces on the label.

This is a Severity Level IV vioiation (Supplement V).

Pursuant to the provisions of 10 CFR 2.201, Commonwealth Edison is hertby -

required to submit a written statement or explanation to the U.S. Nuclear Regulatory Commission, ATTN: Document Control Desk, Washington, D.C. 20555 with a copy to the U.S. Nuclear Regulatory Commission, Region III, 799 Roosevelt Road, Glen Ellyn, Illinois, 60137, and a copy to the NRC Resident Inspector at the LaSalle County Station within 30 days of the date of the letter transmitting this Notice of Violation (Notice). This reply should be clearly marked as a " Reply to a Notice of Violation" and should include for each violation: (1) the reason for the violation, or, if contested, the basis for disputing the violation, (2) the corrective steps that have been taken and the results achieved, (3) the corrective steps that will be taken to avoid further violations, and (4) the date when full compliance will be achieved.

If an adequate reply is not received within the time specified in this Notice, an order or a demand for information may be issued as to why the license should not be modified, suspended, or revoked, or why such other action as may 9209150183 920909 PDR ADOCK 05000373 .
