CONFIRMATORY ACTION LETTER On April 21, 1992, Carolina Power & Light Company (CP&L) management made a decision to shut down both Brunswick units because of concerns with the seismic qualifications of the interior Diesel Generator Buildir.g walls.

During this extended shutdown, additional findings reinforced NRC concerns about the material condition of the station, as well as management effectiveness, and resulted in my June 23, 1992 request of CP&L to submit an integrated performance improvement plan.

CP&L has responded to that request with submittals of July 23, 1992 and November 30, 1992, describing both unit restart actions and longer-term corporate improvement initiatives.

Pursuant to our telephone conversation, and your letters dated July 23, 1992 anc November 30, 1992, it is our understanding that you agree to complete the specific issues identified for Unit 2 in Enclosure 3 of your July 23, 1.992 letter prior to restart of the unit.

In addition to the above, you agreed to:

Repair and test EDG 1 ano inspect EDG 2, 3, and 4 as described in the December 10, 1992, CP&L presentation to the NRC; perform a readiness review of equipment and personnel prior to restart; and meet with the NRC to provide the results of your readiness review and obtain concurrence of the Regional Administrator prior to restart of Unit 2.

Pursuant to Section 182 of the Atomic Energy Act, 42 U.S.C. 2232, and 10 CFR 2.204, you are required to:

Notify me if for any reason you cannot complete the actior.s within l

the specified schedule and advise me in writing of your modified l

schedule in advance of the change, and l

Notify me in writing when you have completed the actions addressed-l_

in this Confirmatory Action Letter.

Issuance of this Confirmatory Action Letter does_ not preclude issuance of an order formalizing the above commitments or requiring other actions on the part-of the licensee. Nor does it preclude the NRC from taking= enforcement action for violations of HRC requirements that may have prompted the issuance of this letter.

In addition, failure to take the actions addressed in this Confirmatory Action Letter may result in enforcement action.

The responses directed by this letter are not subject to.the clearance procedures of the Office of Management and Budget as required by the Paperwork Reduction Acc of 1980, Pub. L. No.96-511.

In accordance with 10 CFR 2.790 of the NRC's " Rules of Practice," a copy of this letter will be placed in the NRC Public Document Room.
