7590-01 UNITED STATES NUCLEAR REGULATORY COMI_S,SION TU ELECTRIC COMPANY 00JKET NO.50-44S NOTICE OF CONSIDERATION OF ISSUANCE OF AMENDMENT TO FACILITY OPERATING LICENSE, PROPOSED NO SIGNIFICANT HAZARDS CONSIDERATION DETERMINATION, AND OPPORTUNITY FOR NEARING The U.S. huclear Regulatory Comission (the Comission) is considering' issuance of an amendment to Facility Cperating License No. NPF-87 issued to TU Electric Company (the licensee) for operation of the Comanche Peak ftaam Electric Station, Unit 1 located in Somervell County, Texas.

The proposed amendment would revise the acceptance criteria provided in the Technical Specifications for the ECCS pump flow balance test. -The purpose of the revision is to al'aw a throttle valve adjustment which assures the minimum required ECCS fivw while preventing the ECCS pumps from exceeding runout' limits.

The minimum flow values presently included in the Technical Specifications'are too high to enture that runout limits will not be reached.

Before issuance of the proposed lic2nse amendment, the Commission will have niade findings required by the Atomic Energy Act of 1954, as amended (the Act) and the Commission's regulations.

The Commission has made a_ proposed determination that the amendment request? involves no significant hazards consideration.

Under the Co:nission's

. regulations in 10 CFR 50.92, this means that operation of the facility in accordance with the proposed amendment would not (1) involve a significant

' increase 1i the probability or consequences of an accident previously evaluated; l

or (2) create the possibility of a new or different kind o* accident from any l

2 accident previously evaluated; or (3) involve a significant reduction in a margin of safety.

As required by 10 CFR 50.91(a), the licennee has provided its analysis of the issue of no significant hazards consideration, which is presented below:

(1) The proposed change does not intolve a significant increase in the probability or consequences of accidents previously evaluated.

The proposed change revises the minimum flow value of certain ECCS injection lines.

Because the systems function as accident mitigation systems, adjustments in the operation of these systems will not increase the probability of an accidert previously evaluated.

In addition, no design, material or construction changes are included in this activity.

Thus, no ct.anges have been proposed which affect the probability of an ac.:ident, The primary accidents affected by the reduction in the minimum ECCS

flow are the Loss of Coolant Accidents (LOCAs).

Evaluations of the analyses i

of these events have demonstrated that the applicable event acceptance F

criterion for_ Peak Cladding Temperature (PCT) continue to be met.

The source term for.the analyses of the radiological consequences of a LOCA is predicated i

on compliance with the PC.T acceptance criterion.

Because the PCT acceptance 4

- criterion is satisfied, there is no effect on the radiological consequences.

L (2) The proposed change does not create the-possibility of a new or

- different kind of accident from any accident previously evaluated.

The proposed change does not modify any hardware, material or construction.

l-Although the flow limits for the-ECCS injection lines are revised, no new h-failure modes are created for any components, systems or structures.

3 (3) The-proposed change does not involve significant reductions in the margin of safety.

fhe proposed change impacts safety in two basic ways.

First, if the ECC., flow values remt.in es-is, it is postulated that the centrifugal charging pumps and the safety injection pumps could reach or exceed their runout limits.

Although this situation was evaluated and it was concluded that these pumps w uld perform their safety function for all postulated accidents at CPSES, safety can be enhanced if these pumps are operated in a range that does not reach the runout limits.

Such an improvement in safety is the primary purpose of this proposed technical specification change.

Adjust'*ng the operating range of these ECCS injection flow lines results in the-second basic impact on safety, In many accident analyses, the assumed-ECCS flow will be lower than previously postulated.

Although the -primary impact is on the LOCA analyses, all affected analyses were assessed.

The margin of safety is the difference between the value of the

-regulated. acceptance-limit for a particular parameter end the failure value associated wit" that parameter.

The primary parameter of interest affected by the rebalancing of the ECCS is the PCT calculated in the LOCA analyses.

Due1to the ECCS rebalancing, the minimum ECCS flow delivered to the Reactor Coolant' System during the injection mode of ECCS operation is reduced.

As a result, the PCT due tc LOCA increases.

However, evaluations of the LOCA analyses have been-performed which demonstrate that the PCT acceptance limit,

defined in 10 CFR 50.46, is not exceeded.

Furthermore, because the ECCS flow reduction does not affect the design, material, or construction of the fuel I

i assemblies, there is no effect on the failure limit associated with the fuel.

Because neither the PCT acceptance limit value nor the associated failure value is changed, there is no ef fect on the targin of safety.

Evaluations of the impact of the proposed change on these analyses have demonstrated that the associ6ted acceptance limits are not exceeded.

Furthermore TV Electric han determined that the reduction in the minimum ECCS flow surveillance criteria allows the ECCS to be balanced such that the pump runout limits will not be exceeded in the recirculation mode.

Therefore, the availability of the ECCS pumps during the post-LOCA, long-term recirculation mode of operation is enhtnced, Although the proposed change will result in higher PCT for some accident analyses due to the reduced flow rates, the fact that all accidents continue to provide acceptable results and all parameters of concern continue to meet acceptance criteria when coupled with the clear improvo.nent in safety which results from not exceeding the pump runout limits, leads TU Electric to the conclusion that this proposed change does not involve a significant reduction in the margin of saftty.

15e NRC staff has reviewed the Itcehsse's analysis and, based on this tsview, 14 epptars that the three standards of 10 CfR 50.92(c) are satisfied.

Inerefore, the NBC staff proposes to determine that the amendment request involves.no signiricant hazards consideration.

The Commission is seeking public comments on this proposed determination.

Any comments received within thirty (30) days after the date of publication of this notice will be considered in making any final determination.

The Commission will not normally make a final determination unless it receives a request for a hearing,

license and any person whose interest 4.ay be affected by this proceeding and who wishes to participate as a party in the proceeding must file a written request for a hearing and a petition for leave to intervene.

Requests for a hearing and a petition for leave to intervene shall be filed in accordance with the Commission's " Rules of Practice for Domestic Licensing Proceedings" in 10 CFR Part 2.

4 1 As required by 10 CFR 2.714, a petition for leave to intervene shall

set forth with particularity the interest of the petitioner in the proceedirg, and how that interest may be affected by the results of the proceeding.

The petition should specifically explain the reasons why intervention should be permitted with particular reference to the following factors:

(1) the nature of the petitioner's right under the Act to be made party to the proceeding; (2) the nature and extent of the petitioner's property, financial, or other 1

interest in the proceeding; and (3) the possible effect of any order which may be entered in the proceeding on the petitioner's interest.

The petition shoulo also identify the specific aspect (s) of the subject matter of the proceedi..g _ as to which petitioner wishes to intervene.

Any person who has filed a petition-for leave to intervene or who has been admitted as e party may amend _the petition without requesting leave of the Board tp to fifteen (15) days prior to the first prehearing conference scheduled in the proceeding,-

but such an amended petition must satisfy the_ specificity requirements described above.

Not later than fif teen (15) days prior to the first prehearing conference scheduled in the proceeding, a petit Sner shall file c b,'pplement to the petition to intervene which must include a list of the to itentions which are sought to be litigated in the matter.

Each contention must consi:t of a specific statement of the issue of law or fact to be raised or controvertec.

In addition, the petitioner shall provide a brief explanation of the bases of the contention and a concise statement of the alleged' facts or expert opinion which support the contention and on which the petitioner intends to ly in prcving the' contention at the hearing.

The petitioner must also provide references to those specific sources and documents of which the petitioner is-

aware and on which the petitioner intends to rely to establish those facts or expert opinion.

Petitioner must provide sufficient information tr show that a genuine dispute exists with the applicant on a material issue of law or f a:t.

Contentions shall be limited to matters within the scope of the amendment under consideration.

The contention must be one which, if proven, would entitle the petitioner to relief.

A petitioner who fails to file such a supplement which satisfies these reg'irements with respect to at least one contention will not be permitted to participate as a party.

Those permitted to intervene bacome parties to the proceeding, subject to any limitations in the order grariing leave to intervene, and have the opportunity to participate fully in the conduct of the hearing, including the opportunity to present eviaence and cross-examine witnesses.

If a hearing is requested, the Commission will make a final determination on the issue of no significant hazards consideration.

The final determination will serve to decide when the hearing is held.

If the final determination is that the amendment request involves r.a

signific, zards censideration, the Commission may issue the amendment and make it immeuiately effective, notwithstanding the request for a hearing. Any hearing held would take place after issuanca of the amendment.

If the final determination is that the amendment request involves a significant hazards consideration, any hearing held would take place before the issuance of any amendment.

Normally, the Commission will not issue the amendment until the expiretion of the 30-day notice period.

However, should circumstances change during the notice period such that failure to act in a timely way would result, for example, in derating or shutdown of the facility, the Commission may issue the license l

\\ amendment before the expiration of tt.e 30-day notice period, provided that its final determination is that the amendment involves no significant hazards consideration.

The final determination will consider all public and State comments received.

Should the Comission take this action, it will publish in the FEDERAL REGISTER a notice of issuance and provide for opportunity for a hearing after issuance.

The Commission expects that the need to take this action will occur very infrequently.

A request for a hearing or a petition for leave to intervene must be filed with the Secretary of the Commission, U.S. Nuclear Regulatory Commission, Washington, DC 20555, Attention:
