Pursuant to 10 CFR $ 2.749, the Applicants hereby move for summary disposition of contention NECNP I.D.3.

This motion is submitted upon the affidavit of William N. Fadden, attached hereto. As therein set j forth the Applicant fully complies with Reg. Guide 1.45 which in turn constitutes an acceptable method of compliance with GDC 30.

GDC 21 has no applicability to the leakage detection system, because it is not part of the Reactor Protection System.

.Thus summary disposition of NECNP I.D.3 is now in order, there being no triable issue of fact.

D STATMENT OF MATERIAL FACTS AS TO WhICH THERE IS NO DISPUTE

1. The Applicants are in full compliance with Reg.

Guide 1.45.

2. The Reactor Coolant Pressure Boundary Leakage Detection System is not part of the Reactor Protection ,ystem.
