NEDC-32163P, " Peach Bottom Atomic Power Station (PBAPS), Units 2 and 3 i
SAFER /GESTR-LOCA Loss-of-Coolant Accident Analysis," Class III, dated January i
1993.
By letter dated July 16, 1993, PECo submitted a report entitled l
" Statistical Analysis of Small Break LOCA Upper Bound PCT for Peach Bottom j
2/3."
Included in PECo's submittal was your affidavit, dated July 15, 1993, i
requesting that the report be withheld from public disclosure pursuant to 10 -
1 CFR Part 2.790.
I You requested that the information identified in PEco's July 16, 1993, letter, be classified as proprietary because it contains details of supporting data and analyses relative to the application of the SAFER /GESTR computer program.
You stated that this program is intended for use as the licensing basis for'
.f boiling water reactor response to loss-of-coolant accidents and that the program was developed at substantial cost.
You stated that the submitted I
information should be considered exempt from mandatory public disclosure for the following reasons:
1.
The information discloses a process, method, or apparatus, including l
supporting data and analyses, where prevention of its use by General Electric's competitors without a license from General Electric constitutes a competitive economic advantage over other companies.
2.
The information which, if used by a competitor, would reduce his expenditure of resources or improve his competitive position in the
( j design, manufacture, shipment, installation, assurance of quality, or
\\i licensing of a similar product.
We have reviewed your application and the material in accordance with the requirements of 10 CFR 2.790 and, on the basis of General Electric's statements, have determined that the submitted information, sought to be l
withheld contains trade secrets or proprietary commercial information.

for Peach Bottom 2/3," dated July 1993, marked as proprietary, will be withheld-from public disclosure pursuant 10 CFR 2.790(b)(5) and Section 103(b) of the Atomic Energy Act of 1954, as amended.

If the need arises, we may send copies of this information to our consultants working in i
this area. We will, of course, ensure that the consultants have signed the appropriate agreements for handling proprietary information.
If the basis for withholding this information from public inspection should change in the future such that the information could then be made available for public inspection, you should promptly notify the NRC.
You also should understand that the NRC may have cause to review this determination in the future, for example, if the scope of a Freedom of Information Act request includes your information.
In all review situations, if the NRC makes a determination adverse to the above, you will be notified in advance of any public disclosure.
