Introductiers. 4 On June 22, 1990, the Nuclear Regulatory Commission ("NRC") published in the Federal Register a notice of " Consideration of Issuance of Amendments-to Facility Operating Licenses and Proposed No Significant Hazards Consideration Determination and Opportunity for Hearing." 55 Fed. Reg. 25756 (the " Notice"). The Notice addressed the May 25, 1990 application of l 90001{0 0 PDR 3 - -. =

t - s l Georgia Power Company (the "Licenseo"), acting for itself and as agent for Oglethorpe Power Corporation, j Municipal Electric Authority of Georgia, and The City i of Dalton, Georgia, for certain amendments to Facility T ' operating Licenses NPF-68 and NPF-81 for the Vogtle Electric Generating Plant Units.1 and 2, respectively i (the " Application"). The Application sought an amendment to the Vogtle Electric Generating Plant, Units 1 and 2 (hereinafter "VEGP") Technical Specifications to permit the Licenses to bypass the emergency diesel generators' high jacket water temperature trip switches during emergency starts. The Application was filed in order to minimize the chance for spurious diesel generator trips in the emergency start mode. The high jacket water . temperature-trip would still be available during non-j. emergency operation and during diesel generator [ surveillance tests. The Notice provided that the NRC would consider comments concerning its proposed determination of no significant hazards consideration.within fifteen days after the date of publication of the Notice. 55 Fed. 2 m- . d A

The Notico also provided, pursuant to the NRC's Rules of Practice, that "any person whose interest may be affected by this proceeding and who wishes to participate as a party.in the proceeding must file a written request for a hearing and a petition for leave to intervene" by July 23, 1990 142 The' Notice further provided detailed instructions respecting the procedure-for filing a petition to intervene in accordance with the NRC's Rules of Practice. 142 On July 10, 1990, the NRC issued Amendment Nos. 31 and 11 to VEGP Facility Operating Licenses NPF-68 and NPF-81, respectively (the " License Amendments"). The License Amendments provided the Technical Specification changes requested by the Licensee, permitting bypassing of the high jacket water temperature trip during emergency diesel generator starts. The safety evaluation accompanying the License Amendments contains the NRC's final determination that the Application involveel no significant hazards consideration and states that no comments to the Notice were received by '3 I

The NRC's safety evaluation states that the l .1 Licensse's design respecting the diesel generator high j jacket water temperature trip, without the bypass, 'f meets NRC regulatory requirements. In addition, the NRC's safety evaluation states that the proposed bypassing does not impact plant safety as analyzed in the updated'VEGP Final Safety Analysis Report ("FSAR"), but rather, represents a safety enhancement. l On July 23, 1990, the Georgians Against' Nuclear 1 Energy ("GANE") filed a document with the NRC described as a " petition for leave to intervene on Dockets No. 50-424 and 50-425 concerning Georgia Power's request for~an amendment to their license to operate (VEGP)..." r (the " Petition"). The Petition further states: 1) Our right to be party to the proceedings lies in our past recognition as intervenor at the Georgia Public Service l Commission on the Vogtle I rate increase request case and at the Atomic Energy Commission and the Nuclear Regulatory Commission in the licensing construction proceedings for Vogtle Nuclear Plant. 2) Our interest in the proceeding stems from a call to help preserve and protect the health, lives and property of the Georgians 4 / l -4 ,,e v v---, v-

l and the citizens of the surrounding area which could potentially be.affected by che i conditions operating at Plant Vogtle. i

3).Specifically our concern is with Georgia Power's request to bypass the high jacket water temperature switch on the backup generator that caused the March 20, 1990, accident at Plant Vogtle.

The switch is designed to keep-coolant running toward the engine of the emergency generator. If this switch is bypassed the potential for the generator engine to overheat is. increased. If the generator engine were damaged no power would be available for the plant site. At a minimur we requ'st that Georgia Power acquire a svitcl that works. In accordance with 10 CFR S 2.772(j), the Petition was referred by the NRC Secretary to the Chief Administrative Judge of the Atomic Safety and Licensing Board Panel on July 27, 1990. Thereafter, on August 1, l 1990, the Acting Chief Administrative Judge of the Panel established the Board. l. l' II. The Petition. A.. The Board should treat the Petition as a reauest for NRC Staff consideration of written comments. The Petition simply requests leave to intervene I without requesting a hearing. Since GANE filed a petition to intervene and request for a hearing in the 5 / 1 1

This requirement for j specificity is especially critical in the case of an I operating license amendment proceeding since, without ] such a request, a hearing normally is not held. Moreover, the Petition read literally suggests that GANE does not wish to participate in a hearing, but that it merely wishes to express its " concern." l Therefore, the Board should not order a hearing based i a L on the present Petitions and should treat the Petition as written comments which GANE requests the NRC Staff to consider. Of course, the Licensee and the NRC Staff have already carefully considered GANE's stated concern. .The NRC safety evaluation, discussed above, addresses i L that concern in detail. Based on the foregoing, the Board should treat the Petition as a request for consideration of written I comments. And, since such coisments have been I adequately addressed in the course of the License Amendments issuance process by the NRC Staff, the Board should forego further consideration of the Petition. t 3. The Petition falls short of the minimum i recuirements anolicable to a petition for leave to intt.?vene in an NRC license amendment oroceedina. Should the Board undertake further consideration of the Petition,- it is clear that the Petition does not meet the minimum requirements of NRC's Rules of Practice for such petitions. As the Board is well i aware, the NRC's Rules of Practice contained in 10 l-C.F.R. Part 2 require that a petition for leave to intervene set forth with particularity the following: 3 1) The interest of the petitioner in the i proceeding; .a l~ L 7 1 I l 4

S. 2. 714 (a) (2 ) and (d)(1). With the possible exception of item (3) above, the Petition has failed to meet the-above requirements. In support of its right under the Act to be made a party to the License Amendments proceeding, GANE has 8

o, V 4 relied on the past recognition by the Georgia Public Service Commission of its status as an intervanor in the "VEGP Unit I rate case" and, apparently, by the NRC of its status'as an intervenor in the 1984 VEGP operating license proceeding. Such_ reliance on status L in those two proceedings is misplaced and insufficient. In Portland General ~ Electric Co. (Pebble Springs v - Nuclear Plant, Units 1 and 2), CLI-76-27, 4 NRC 610, 613-14 (1976), the NRC ruled that judicial concepts of standing apply in determining whether to grnnt a petition for leave to intervene under the Act. Judicial concepts of standing require a showing that (a) the action sought in the proceeding will cause L " injury-in-fact," and (b) the injury is arguably within l the " zone -of interests" pr otected by the Act. Metrocolitan Edison Co. (Taree Mile Island Nuclear Station, Unit 1), CLI-83-25, 18 NRC 327, 332 (1983). A L petitioner may base its standing upon a showing that i his or her residence, or that of its members, is within the geographical zone that might be affected by an accidental release of fission products. Additionally, an organizational intervenor must show, f 3 3 by way of affidavit, that the members on whom it relies for standing (1) consider themselves personally aggrieved by the proceedings, and (2) authorize the organization to represent them. Houston Lichtina and 'f Epwer Co. (Allens Creek Nuclear Generating Station, Unit 1), ALAB-535, 9 NRC 377, 392-97 (1979).* The 9 Petition fails to meet any of the foregoing standing requirements. Although GANE may be able to establish that its t l _ members are ratepayers of Georgia Power Company, such a I showing does not confer standing to intervene in an NRC license amendment proceeding concerning technical specification amendments. Portland General Electric C22, -4 NRC at 614.- Additionally,' while GANE may have established standing to intervene in the 1984 VEGP operating license proceeding, which has since been . terminated, standing _to intervene in any proceeding

Membership undoubtedly changed over the course of a-half dozen years, and authorization of representation by individual members cannot be assumed when the scope of the proceeding is substantially dissimilar. Furthermore, in the case of a license amendment procesding with little, if any, potential for off-site l effects, far closer proximity of residence than that-i required for an operating license proceeding has been required for standing. Boston Edison Comoany (Pilgrim i Nuclear Power Station), LBP-85-24, 22 NRC 97, 99 (1985), aff'd on other arounds, ALAB-816,-22 NRC 461 (1985); see also Philadelohia Electric Co. (Limerick Generating Station, Unit 1), LBP-86-9, 23 NRC 273, 275-i 7 <6 - (19 8 6 ) (with respect to one aspect of a license amendment, petitioner's residence 20 miles from the plant was held to be "too far for any ' injury-in-fact' to him"). These decisions no doubt arise from the requirement contained in 10 C.F.R. S 2. 714 (d) (1) (iii), that the petitioner show how any order in the proceeding could possibly effect its interests. 11

I t In the case of the VEGP License Amendments, the potential for any adverse offsite consequences of issuance is extremely remote. The NRC Staff's safety evaluation'found that the License Amendments are in full compliance with NRC regulations, do not affect adversely plant safety as analyzed in the FSAR and, in fact, represent a safety enhancement. In connection with environmental considerations, the NRC safety evaluation found that the License Amendments involve no significant increase in the amounts, and no significant change in the types, of any effluents that may be released offsite. Based on the foregoing, the Licensee submits that'GANE cannot-establish standing to intervene in the License Amendments proceeding -- as required by 10 CFR S 2.714, no nexus has been alleged between the broad (albeit vague and insufficient) interests o' CINE and how the actions approved by the License Amendments will affect those interests." Therefore, should the Board not treat the Petition as 'The Licensee notes that assuming proper, authorized representation of GANE members proximate to the VEGP, such members cannot reasonably assert that the License Amendments could have an adverse effect on his or her interests protected by the Act. 12

The Petition states, in effect, that the aspect of the subject matter of the License Amendments proceeding-which-it wishes to address is the bypassing of the diesel genecator jacket water temperature trip. GANE i also requests that the NRC require the Licensee to i acquire a " switch that works."' GANE has not contended T that the Licensee has failed to meet any.of its statutory or regulatory obligations. Nor does GANE L assert that there exists a health and safety concern which the NRC impermissibly has failed to address. Rather, in essence, what GANE asserts is that NRC regulations do not adequately protect health and safety because they do not require the Licensee to procure a l-l SWe also address the latter concern in Section II. D., infra. 13

Therefore, the Petition should be e denied. In Public Service Comoany of New Hamnshire, et al. (Seabrook Station, Units 1 and 2), LBP-82-106, 16 NRC q. 1649 (1982), the licensing board held that an 1 intervenor's' statement of the reasons for his contention must either allege with particularity that l an opplicant is not complying with a specified regulation, or allege with particularity the existence and detail of a substantial safety issue on which the l regulations are silent. Id s at 1656 (citina 10 C.F.R. S l-g 2.758). While the foregoing rule applies to contentions rathsr than petitions to intervene, the Petition is drawn such that the foregoing rule cannot be met relative to any contention arising from the Petition. Any contention which GANE might submit within the scope of the concerns raised in the Petition cannot reasonably allege either (1) that the Licensee t is not complying with a specified regulation, or (2) 14 1 i L

j '.c i l i j I i the existence and detail of a substantial safety issue on which the regulations are silent. i D. The Petition asserts a concern which is not within the scone of the License Amendments croceedina. ( t In addition to the defects in the Petition-i described above, the Petition raises a concern which is t not within the scope of the issues set forth in the NRC's June 22, 1990 Notice. GANE requests that the Licensee " acquire a switch that works."' It is settled that, in determining whether it-is-f empowered to entertain a particular issue, a licensing board must respect the terms of the notice of ( opportunity for a hearing published by the NRC for the proceeding in question. 'The issue of whether or not the VEGP diesel. generators have high jacket water temperature trip switches which operate properly, or whether operable switches are necessary to support an NRC finding of reasonable assurance, are not within the scope of the issuance of the License Amendments. The NRC's Rules-of Practice provide adequate alternative opportunities for GANE to be heard on these other issues. Issuance of the License Amendments involves only the issue of rhether the high jacket water temperature trip may be safely bypassed. Ema-the NRC safety evaluation accompanying the License Amendments which is limited to the issue of whether the trip. switches may be bypassed.
