Board directed all parties to file bi-monthly progress reports on discovery activities, on the last working day preceding the 7th of each month and on the last working day preceding the 22nd

! of each month. The Board orally modified that filing schedule

at the close of the October 30, 1981 hearing, to eliminate the -

i requirement for filing the first report each month. Tr. 701, 740.

On January 20, 1982, Licensee received Decade's January 18 letter to Staff counsel, submitted in response to the Board's order (issued during the January 11 conference call) compelling Decade's full response to the Staff's December 2, 1981 interrogatories and Licensee's November 10 and November 20, 1981 interrogatories. At I

i the time Licensee's fourth discovery progress report was filed, d f Licensee was still reviewing the January 18 letter to determine /I t

whether Decade's responses complied with the letter and the spirit of the Board's order compelling those responses.

  • Pursuant to Licensee's review of Decade's January 18 7 letter, " Licensee's Motion To Further Compel Decade's Responses To Interrogatories" was filed on February 2, 1982. In a letter to counsel for Licensee dated February 5, 1982, Decade indicated that it would not file a response to Licensee's February 2 motion.

Accordingly, that motion is now ripe for disposition by the Board.

l " Decade's First Interrogatories and Request For Production of Documents To Licensee On The Full Scale Sleeving Program" were filed February 10, 1982. Licensee will respond to thoc.e interroga-4 tories on or before March 1, 1982. There are no other discovery c

requests pending with Licensee, and Licensee has no discovery requests pending with the Staff. Licensee does not presently anticipate seeking follow-on discovery of Decade; nor does Licensee intend to seek discovery of the Staff.
