PACIFIC GAS AND ELECTRIC COMPANY'S RESPONSE TO GOVERNOR _ BROWN'S SUPPLEMENT TO PETITION FOR REVIEW OF ALAB-644 On October 30, 1981, Governor Brown filed a " Supplement to Petition for Review of ALAB-644."
In reviewing that document Pacific Gas and Electric Company can only state that the document should be summarily dismissed.
It is both procedurally and substantively inadequate.
The " supplement" does not cite anywhere within the document any finding or portion of ALAB-644, nor does it reference any regulation which permits the filing of such a supplement.
In essence the " supplement" appears to be nothing more than yet another of the Governor's many unauthorized attempts to influence the ultimate decision makers in this case.
The issues raised by Governor Brown deal with recently discovered matters which have been pending before this Commission and the NRC Staff for the past several months.
They are of 0$

a concern to Pacific Gas and Electric Company, the Staff, and the Commirsion.
However, their impact on the Appbal Board's seismic decision is not, as Governor Brown would lead one to believe, of any significance.
ALAB-644 deals with the seismic process from the capability and magnitude of the Hosgri fault to the accelerations and required design to be expected at the Diablo Canyon facility. The argument brought forward in Governor Brown's supplement deals with matters outside the scope of that review.
For the reasons sets forth above it is respectfully submitted that the improperly filed " Supplement to Petition for Review of ALAB-644" be dismissed.
