General Electric Company Power Systems Management Business Department Docket No. 99900352/81-01 NOTICE OF VIOLATION As a result of the inspection conducted on June 23-26, 1981, and in accord-ance with the Interim Enforcenent Policy, 45 FR 66754 (October 7, 1980),

the following violation was identified:

Paragraph 21.6 of l H le 10, Part 21, of the Code of Federal Regulations, states in part, "Each individual partnership, corporation or other entity subject to the regulations in this part, shall post current copies of the following documents in a conspicuous position on any premises, within the United States where the activities subject to this part are conducted (1) the regulations in this part, (2) Section 206 of the Energy Reorganiza-tion Act of 1974, and (3) procedures adopted pursuant to the regulations in this part.

If posting of the regulations in this part or the procedures adopted pur-suant to the regulations in this part is not practicable... in addition to posting section 206, post a notice which describes the regulations /

procedures, including the name of the individual to whom reports may be made, and states where they may be examined."

Contrary to the above:

a.

A current copy of 10 CFR Part 21 was not in the file of the individual identified in the notice posted at the Rio Piedras facility.

The available copy of 10 CFR Part 21 was identified as:

Federal Register Volume 42, No. 108 - Honday, June 6, 1977.

b.

The notice posted at the Vieques Island facility, had a space for, but did not include the name or location of the individual where 10 CFR Part 21 or the procedure to be followed could be examined, and these documents were not available for review during the cource of this inspection.

Notes:

Prior to departure from the facility, a notice with the required information was posted; however, it identified the Philadelphia location for access to 10 CFR P r t 21 and the adopted procedure.

This is a Severity Level VI Violation (Supplement II).
