Dear Mr. Chairman:

This is to inform the Subconnittee on Energy and the Environment that the Commission has received additional antitrust advice from the Attorney General in connection with Duke Power Company's construction permit application for Cattwba Nuclear Station. Unit No. 2.

This advice is rendered pursuant to section 105c of the Atomic Energy Act of 1954, as amended.

A copy of the Attorney General's letter dated July 31, 1 981, is enclosed.

In his letter he concludes:

" Review of the information submitted to the Department has not-disclosed antitrust problems attending [Piednont Municipal Power Agency] PHPA's participation in the plant. PHPA's participation, consisting of a 25% individual ownership interest in Catawba Nuclear Station, Unit 2, will not create or maintain a situation inconsistent with the antitrust laws. We do not, therefore, believe it necessary for the Commission to hold an antitrust hearing."
