As a follow-up to the Staff letter of July 15, 1980, representatives of the NRC Staff, Licensee and the several petitioners seeking to intervene in the captioned matter met on August 18 to continue the discussion of proposed contentions begun on July 11. The parties to these discussions requested Staff counsel to supply this report on the results of these meetings.

Licensee has waived its objections to Mr. Lochstet's standing to intervene.

Licensee and Staff also agree that all petitioners have advanced at least one litigable contention so as to satisfy the applicable intervention require-ments of 10 C.F.R. 5 2.714. Therefore,. Licensee and,taff agree that all petitioners should be admitted as intervenors. Pet'.ioner Steven Sholly has withdrawn all of his proposed contentions, with the exception of contention 4, on the basis of certain agreed upon changes in the proposed technical specifi-l cations and additional understandings reached during these meetings. Further discussion of contention 4, regarding record retention, is necessary.

Mr. Sholly intends to provide separate written notification to the Board j

to this effect. Modifications in the Director's February 11, 1980 Order to reflect the agreement on changes in the proposed technical specifications are in preparation. Dr. Judith Johnsrud has withdrawn contention 2 proposed by Petitioner Environmental Coalition on Nuclear Power (ECNP). The balance of the contentions proposed by ECNP, and those of Petitioner William Lochstet, are under further discussion.

Informal resolution of some or all of these contentions is anticipated. Therefore, the parties join in requesting the Board to enter an order formally allowing intervention but to defer an early ruling on the admissibility of those contentions remaining for discussion in order to provide the parties a reasonable period of time to complete their l

negotiations. ~ A further report to the Board on the status of negotiations and recommendations for further action in this proceeding will be made within 30 days.
