APPENDIX A NOTICE OF VIOLATION Baltimore Gas and Electric Company Docket No. 50-317 Based on the results of an NRC inspection conducted on September 1-29,1980, it appears that one of your activities was not conducted in full compliance with the conditions of your NRC License No. DPR-53 as discussed below.

10 CFR 50, Appendix B, Criterion X, Inspection, states in part:

"A program for inspection of activities affecting quality shall be established and executed by or for the organization performing the activity to verify conformance with the documented instructions, procedures, and drawings for accomplishing the activity...

Examinations, measurements, or tests of material or products processed shall be performed for each work operation where necessary to assure quality..."

The NRC approved Qualtiy Assurance Manual states in QA Policy Section 10, "activi-ties affecting the quality of safety related items during the Operating Phase of the Calvert Cliffs Nuclear Powcr Pla t are inspected as specified in approved instructions, procedures, and plans which set forth requirements and acceptance criteria to ensure that work is done in conformance with particular requirements.

Contrary to the above, the inspection program for the Unit 1 Spent Fuel Storage Rack modification did not verify conformance to requirements; in that inspection did not identify actual improper spacing of the storage racks.

The improper spacing was identified by NRC inspection on September 12, 1980, after completion of the licensee's installation verification for racks NES 1, 2 and 3.
