Dear Mr. Schwencer:

In the referenced letter it was stated that NRC was unable to determine from the review of the Waterford FSAR Section 3.2.2 the extent to which we meet the positions of Regulatory Guide 1.26, " Quality Group Classi-fications and Standards for Water , Steam , and Radioactive-Weste-Containing Components of Nuclear Power Plants". NRC specifically I inquired as to our comformance with the inspection requirements of the ASME Code,Section III. It is hoped that the following will provide appropriate clarification.

As stated in FSAR Sections 1.8 and 3.2.2, the Waterford 3 project satisfies Regulatory Guide 1.26 (June 1975). Although neither 10CFR 50.55a nor the Regulatory Guide require application of the Code N-symbol, it has in fact been applied on our Quality Group A and B components (Safety Classes 1 and 2 respectively). Quality Group C (Safety Class 3) l components have also been procured, designed, fabricated and tested in i accordance with the requirements of the ASME Code,Section III, Class 3.  !

These components were in fact purchased only from suppliers who possess the proper ASME Certificates of Authorization. However, in accordance with an agreement reached with the State of Louisiana, the Code-N symbol was not applied to Safety Class 3 components (see Attachment I). Thus, the third party inspection that accompanies the N-symbol was not required.

This agreement was and is consistent with NRC regulations since the licensee's Quality Assurance program ensures that an inspection equivalent l to that performed in conjunction with an N-stamp is imposed on Safety Class \

3 components. \

Mr. Albert Schwencer LPL 14099 Page 2 As stated above, inspection of Safety Class 3 components is being performed under the licensee's Quality Assurance Program to ensure that all ASME Section III requirements are being met. This program was deemed acceptable by the NRC in SER Supplement 2 to the Waterford 3 PSAR.

This innpection program is accomplished through the use of checklists which designate witness points to ensure that important operations i.e.,

hydrostatic and performance testing, NDE, are being performed in accor-dance with approved written procedures using qualified personnel in accordance with Code requirements. Further, all documentation packages are reviewed for Code required documents. This inspection, in conjunc-tion with the supplier's Certificate of Authorization, assures that the component meets all the applicable requirements of ASME Section III.

It should be further noted that NRC Region IV conducted an inspection of LP&L's conniement to Code Class 3 and the results of that inspection in Report No. 79-01 indicate no items of noncompliance in this area. A copy of the report is attached as Attachment II.

Dear Mr. Pfatt:

This is in reference to my telephone conversation with Mr. A. E. Henderson on Friday, January 12, 1973 relative to the application of the "N" sts:cp to Class 3 ccuponents of your Waterford 3 Nuclear station.

We have studied your request to purchase ASME Class 3 components for Vnter-ford 3 without applying the "N" stamp. Ve feel that we can approve this request, with the provision that such components be built according to Section III of the ASME Boiler and Pressure Vessel Code.by rnnufacturers holding the required ASME Certificate of Authorization.

We ask that you keep us fully informed as to the progress of your applica-tion for the construction permit for the Waterford 3 station.
