SUBJECT:

REVOCATION OF TYRONE CONSTRUCTION PERMIT By the enclosed Order, the Comission has denied the request of the North Dakota Public Service Comission and the South Dakota Public Utilities Comission to reconsider the Comission's November 3,1980, decision denying the Dakota Comissions' request for hearing and to defer revocation of the Tyrone construction permit. You had proposed revocation of the Tyrone permit in an Order to Show Cause issued in June 1980 (45 F.R. 42,093). The licensee consented to revocation of the Tyrone permit, but further action was str.yed pending disposition of the Dakota Comissions' requests by the Comission.

Because the Dakota Comissions' original request (and their petition for reconsideration) has been denied, you are now left with the final act of revoking the Tyrone construction permit. As you may be aware, issuance of the Order to Show Cause in June only proposed revocation in accordance with the requirements of 10 C.F.R. 2.202 and did not in itself constitute revocation of the Tyrone pemit.

In the Staff's filing before the Comission, we indicated that the Director of NRR would issue a final order revoking the permit upon the Comission's dental of the petition for reconsideration. Accordingly, I have enclosed a draft letter and order which will finally revoke the Tyrone permit. This order should be issued as soon as possible. The order should be published in the Federal Register.

Dear Mr. Dienhart:

On June 16, 1980, I issued an Order to Show Cause why the Tyrone con-struction permit should not be revoked. The Order to Show Cause was based on the announced cancellation of the Tyrone project b; the croject's co-owners. Counsel for the co-owners informed me on July 1,1980, that the co-owners had consented to the proposed revocation of the permit.

The North Dakota Public Service Comission and the South Dakota Public Utilities Comission requested on July 11, 1980, that the NRC defer the pro-posed revocation and that the Dakota Comissions be granted a hearino if one was necessary to act on their request for deferral. As you may be aware, the Commission has denied the Dakota Comission's requests on November 3,1980, and by its Order of December 24, 1980, the Comission denied a petition for reconsideration of the November 3rd decision. Accordingly, I am issuing the enclosed Order Revoking Construction Permit which finally revokes the Tyrone pendit.

ORDER REVOKI'lG CONSTRUCTION PER"IT I

Northern States Power Company el al. ("the co-owners") hold Construction Permit No. CPPR-157 which authorizes the construction of a nuclear power reactor at the Tyrone Energy Park in Dunn County, Wisconsin.

Construction Pemit No. CPPR-157 was issued on December 27, 1977 and would otherwise expire on October 1,1985.

II On July 24, 1979, Northern States Power Company announced that the co-owners of the proposed Tyrone Unit 1 had voted to cancel the project. Northern States Power informed the NRC of the intended cancellation and asked the Office of Nuclear Reactor Regulation (NRR) to stop further action on the Tyrone docket. The Atomic Safety and Licensing Appeal Board granted the company's reouest to teminate remaining proceedings involving the Tyrone construction pemit.

In August 1979, the 'oadger Safe Energy Alliance reouested pursuant to 10 C.F.R. 2.206 that the Director of NRR revoke the Tyrone construction pemit.

On June 16, 1980, the Director of NRR issued under 10 C.F.R. 2.202 an Order to Show Cause why the Tyrone construction pemit should not be revoked.

45 Fed. Reg. 42,093 (June 23, 1980). The co-owners of the Tyrone project consented to the entry of an order revoking the construction pemit. However,

. the Ncrth Dakota Service Connission and the South Dakota Public Utilities Cmanission asked on July 11, 1980, that the NRC defer the proposed revocation of the Tyrone construction permit and grant the Dakota Conmissions a hearing if one was necessary to act on the request for deferral. The Dakota Commissions based their requests on the alleged economic injury to Dakotan ratepayers that might flow from the cancellation of the Tyrone project. The Dakota Commissions' requests were referred to the Commission for disposition. On November 3,1980, the Commission denied the Dakota Commissions' requests for deferral of revocation and for a hearing. See Northern States Power Co.

(Tyrone Energy Park, Unit 1), CLI-80-36,12 NRC (1980). On November 13, 1980, the Dakota Commissions petitioned for reconsideration of the Canmission's November 3rd decision. The Commission denied the petition for reconsideration in its Order of December 24, 1980.

III In light of (i) the Commission's denial of the Dakota Commission's petition and (ii) the co-owners consent to entry of an order of revocation, it is hereby ordered that pursuant to 10 C.F.R. 2.202(d) and (e) Construction Permit No. CPPR-157 is revoked.

This Order is effective upon issuance.
