COOK GRAD JURY SUBPOENA On August 27,

1984, OGC accepted service of ti.e attached subpoena from the Grand Jury for the Western District of Michigan requiring the production, by September 18,
1984, of any and all documentation and information

. relevant to or generated in connection with or as a result of the issues involved with 10 CFR 50.48 and Appendix R to 10 CFR Pari 50 developed after July 31, 1979, concerning the D.C.

Cook Nuclear Power Plant whether they exist in agency official files or in past or Present employees'ersonal files at any location."

Based on conversations with the Department of Justice, the Grand Jury is specifically interested in any records,

notes, or telephone/meeting

'logs reflectirg:

(1) the basis for individual agency decisionmakers'ositions on the existence or non-existence of a material false state;ent; (2) the existence and substance of communications between D.C.

Cook representat'ves and agency personnel; (3) the existence and substance of communication between Gerald Charnoff, as legal representative of D.C. Cook, and agency personnel; and (4) internal advice or recommendations to staff inspectors or investigations on the merits of the D.C.

Cook investigation and/or its results.

Roger Fortuna, Oi, will coordinate the physical production of responsive oocuments to the Grand Jury.

To ensure our timelv response, a list of responsive documents, together with copies of those documents, should be provided directly to Mr. Fortuna by c.o.b.

September 12, 1984.
