  • REQUEST FOR WITHHOLDING INFORMATION FROM PUBLIC DISCLOSURE (TAC NOS. 76327, 76328~ 76347, 76348, 76335, 76336)
  • By letter dated April *26, 1990, you provided your response to NRC Bulletin 90-02, "Loss of Thermal Margin Caused by Channel Box Bow, 11 for Dresden Station, Units 2 and 3; Quad Cities Station, Units 1 and 2; and LaSalle County Station, Units 1 and 2.

You requested that Attachment B 9f your letter be withheld from publi.c disclosure pursuant to 10 CFR Part 2.790 and included information provided by a vendor indicating that the Attachment contains trade seciets of~value to competitors.

We have reviewed your request and the material in accordan~e with th~

requirements. of 10 CFR 2.790.

On the basis of the vendor's statements, we have

  • determined that the submitted information contains details concerning the vendor's fuel designs which were developed at considerable expense to the vendor and affords the vendor a vital advantage over its competitors ~ho do not, or may not, know or use the information contained in the submittal. Public disclosure would likely allow competitors to reduce* their expenditures and*

improve their competitive position by providing insights into the vendor's licensing methodology, thereby resulting in substantial harm to the competitive position of the vendor.

Ther~fore, Attachment ~ of your submittal will be withheld from public disclosure pursuant to 10 CFR Part 2.790(b)(5) and Section 103(b) of the Atomic Energy Act of 1954, as amended.

Withholding from public inspection shall not affect the right, if any, of persons properly and directly concerned to inspect the documents.

If the need arises, we may send copies of this information to our consultants working in this area.

We will, of course, ensure that the consult~nts have signed the appropriate agreements for handling proprietary information.

If the basi~ for withholding this information from public inspection should change in the future, such that the information could then be made available for public inspection, you should promptly notify the NRC.
