On August 11, 2016, a closed meeting was held between the U.S. Nuclear Regulatory Commission (NRC) and representatives of Exelon Generation Company, LLC at NRC Headquarters, One White Flint North, 11555 Rockville Pike, Rockville, Maryland. The purpose of the meeting was to discuss proprietary information regarding lead test assemblies. The meeting notice, dated August 1, 2016, is available in the Agencywide Documents Access and Management System (ADAMS) at Accession No. ML16209A306. A list of attendees is provided as Enclosure 1.

The licensee presented proprietary information related to lead test assemblies that potentially could be placed in the core at a future date. A related exemption request to Title 10, Code of Federal Regulations (10 CFR), Section 50.46, could potentially be submitted during the middle of 2017. The licensee stated that it has not yet completed the 10 CFR Section 50.59 review to determine if a license amendment is required to be submitted to the NRC.

The NRC staff determined that it is likely that a decision regarding the approval of the potential exemption could be made within a year of submittal. The NRC staff encouraged the licensee to engage Region Ill inspectors regarding the 10 CFR 50.59 review to avoid late breaking regulatory concerns. No regulatory decisions were made during the meeting.
