RESPONSE TO EXTENSION REQUEST FOR DETERMINATION OF DENIAL OF NON-CITED VIOLATION
Dear Mr. Hardy:
This is in response to your letter, dated March 11, 2016, requesting an extension of time to determine whether Entergy will contest the Non-Cited Violation (NCV) regarding the failure to perform a required Title 10 Code of Federal Regulations (CFR) 50.59 evaluation for declassification of the chemical and volume control system. The NCV was documented in U.S. Nuclear Regulatory Commission (NRC) Integrated Inspection Report 05000255/2015004, dated February 12, 2016. Your letter requested an additional 60 days from March 11, 2016, to make your determination.
I have been authorized, after consultation with the Director, Office of Enforcement, to grant Entergy 60 days from March 11, 2016, to determine whether the NCV will be contested.
In accordance with 10 CFR 2.390 of the NRC's "Rules of Practice," a copy of this letter will be made available electronically for public inspection in the NRC Public Document Room and in the NRCs Agencywide Documents Access and Management System (ADAMS), accessible from the NRC Web site at http://www.nrc.gov/reading-rm/adams.html.
