Dear Chief Adams:

In the absence of an Executive Director, the RIAEC has taken on the responsibility of taking administrative actions such as reporting non-compliances and other major administrative matters to support reactor operations. Under this authority, the Commission has decided that as an administrative matter to accept the recommendation of Mr. Davis to implement a special procedure to restore temporary compliance to Technical Specification 6.2.2. The special procedure has been reviewed by the Commission which finds it an acceptable means, on a temporary basis, to satisfy the qualifications requirement of T.S. 6.2.2. Additionally RINSC Technical Specification 6.2.4 gives us the authority to appoint a qualified alternative for the RSO in the event of a temporary vacancy.

.-. 4£ We plan to"'06t into effect a measure that will allow us to comply with T.S. 6.2.2 and restore reactor operations, which were suspended following last week's meeting of the RIAEC and the Commission's discovering re: the RSO's qualifications.

The Commission signed an agreement with Dr. Christopher Reinhlardt, :wkho wili*servi4-as§agting RSO per the conditions in the attached-signed copy of the agreement.

Please know that the Commission will move swiftly to a permanent solution, which will likely involve options other than any amendment to soften T.S. 6.2.2.

Agreement for Radiation Safety Services Between Dr. Christopher P. Reinhardt And The Rhode Island Atomic Energy Commission Whereas the Rhode Island Atomic Energy Commission (RIAEC) is in need of a qualified RSO in order to continue the operation of the RINSC Research Reactor, and Whereas Dr. Christopher P. Reinhardt has the necessary educational qualifications and experience to perform the duties of an RSO at the RINSC Reactor facility, Therefore the following agreement shall be made between Dr. Reinhardt and the Commission:

1. Dr. Reinhardt agrees to serve as the Acting Facility RSO for the Rhode Island Atomic Energy Commission until either party wishes to terminate the agreement.
2. Your duties will be to oversee the activities of the current person serving in the RSO capacity to assure that they are being properly performed in accordance with RINSC Technical Specifications and good radiological control practices.
2. The Rhode Island Atomic Energy Commission agrees to schedule reactor operations with Dr. Reinhardt prior to making commitments with users.
3. Dr. Reinhardt agrees to make every effort to be available at the facility to provide services, as needed.
4. The Rhode Island Atomic Energy Commission agrees to reimburse Dr. Reinhardt for his travel expenses at the prevailing state of State of Rhode Island travel policies.
5. Should any of BioPal's or Dr. Reinhardt's experiments be in the reactor, the NRSC will consider all such experiments with Dr. Reinhardt abstaining from the vote. If a new BioPal experiment requires RSO-level consideration, an external review of safety considerations at the discretion of the NRSC will be made.

This agreement is effective April 25, 2013 and shall remain in effect until either party wishes to end the agreement.
