Dear Mr. Roe:

The U.S. Nuclear Regulatory Commission (NRC) staff received your letter dated March 5, 2010, which provided industrys responses to the staffs generic Requests for Additional Information (RAIs) on Appendix A to Nuclear Energy Institute (NEI) 08-09 Revision 3 (Agencywide Documents and Access Management System (ADAMS) accession number ML100670357).

Additionally, the NRC staff reviewed the supplemental responses to the Appendix A RAIs that were received on April 2, 2010 (ADAMS accession number ML100950119). As you know, the NRC staff committed to review the industrys responses to the RAIs in a continuing effort to streamline and standardize the site-specific licensee cyber security plans that are based on NEI 08-09 Revision 3. In so doing, NRCs site-specific licensing activities should be able to be completed in a more efficient and timely manner.

The NRC staff has found your March 5, 2010, and April 2, 2010, responses to the generic RAIs on Appendix A to NEI 08-09 Revision 3 to be acceptable. It is my understanding that the industry is continuing to collaborate in the timely resolution of the additional generic RAIs associated with the NEI 08-09 Revision 3 security control appendices. The staff looks forward to future correspondence addressing these issues.
