NextEra Energy Point Beach, LLC (NextEra) submitted License Amendment Request (LAR) 241 (Reference 1) to the NRC pursuant to 10 CFR 50.90. The license amendment would revise the current licensing basis to implement the alternative source term (AST) through reanalysis of the radiological consequences of the Point Beach Nuclear Plant (PBNP) Final Safety Analysis Report (FSAR) Chapter 14 accidents.

Document Control Desk Page 2 Via letter dated January 27, 2009 (Reference 2), NextEra transmitted proposed License Conditions related to LAR 241 to replace the Regulatory Commitments submitted in Reference (1). Via letter dated July 24, 2009 (Reference 3), NextEra transmitted revisions to the proposed License Conditions submitted in Reference (2). Via letter dated October 2, 2009 (Reference 4), NextEra transmitted an additional proposed License Condition to be added to the proposed License Conditions submitted in Reference (3).

Enclosure I transmits a revision to the License Conditions proposed in Reference (4).

The revision incorporates schedule changes presented during the public meeting held with the NRC on January 27,2010 (Reference 5).

The second License Condition proposed in Reference (4) for Operating License DPR-27 has been completed. This License Condition stated, "NextEra Energy Point Beach will modify the containment spray (CS) and residual heat removal (RHR) systems to provide throttling capability of CS and RHR during the emergency core cooling system (ECCS) recirculation phase. These modifications will be completed on a unit-specific basis at the next Unit 2 (2009) refueling outage." Accordingly, the proposed License Condition has been withdrawn.

The revision to the proposed License Conditions has been reviewed by the Plant Operations Review Committee.

Summary of Regulatory Commitments This letter contains no new Regulatory Commitments. The following Regulatory Commitment was contained in NextEra's letter dated February 20, 2009 (Reference 6):

0 The VNPAB system will be added to the scope of the Maintenance Rule (1 0 CFR 50.65) and the scope of the License Renewal Program (10 CFR 54.37(b)). These actions will be completed during the Unit I (Spring 2010) refueling outage that implements the LAR.

This Regulatory Commitment is revised as follows:

e The VNPAB system will be added to the scope of the Maintenance Rule (1 0 CFR 50.65) and the scope of the License Renewal Program (10 CFR 54.37(b)). These actions will be completed no later than the Unit 2 (201 1) refueling outage that implements the LAR.

The information contained in this letter and its enclosure do not alter the no significant hazards consideration contained in Reference (1) and continues to satisfy the criteria of 10 CFR 51.22 for categorical exclusion from the requirements for an environmental assessment.

No credit is taken by AST for the PAB charcoal filters. NextEra Enerav Point Beach. LLC will revise PBNP EOPs to address startina the VNPAB fans. This modification is scheduled to be completed followina Nuclear Reaulatory Commission (NRC) aoproval of LAR 241. "Alternative Source Term." no later than the Unit 2 1201 1 ) refuelina outaae.

NextEra Enerav Point Beach. LLC will oerform Train B Emeraencv Diesel Generator load testina over a ranae of 2877 to 2950 kW at rated power factor followina im~lementation of LAR 241 in accordance with the testina schedule.

This license condition will remain in effect until imolementation of LAR 261 for Unit 2.
