ACKNOWLEDGMENT OF DISPUTED VIOLATION LASALLE COUNTY STATION, UNITS 1 AND 2 INSPECTION REPORT 05000373/2008007; 05000374/2008007

Dear Mr. Pardee:

This letter acknowledges the letter from Mr. D. Enright, Exelon Generation Company, LLC (Exelon), LaSalle County Station to the NRC, dated January 29, 2009, which provided a response to our inspection report issued on December 31, 2008, concerning activities conducted at your LaSalle County Station facility. The letter contested one of the Non-Cited Violations (NCVs) contained in the NRC Triennial Fire Protection inspection report, namely NCV 05000373(374)/2008007-02, associated with the Failure to Provide a Sprinkler System for Fire Zone 4F3.

We are currently reviewing Exelon=s basis for contesting the NCV, which involves research into the original licensing basis for the LaSalle County Station facility. The NRC seeks to be thorough and timely in the review of licensee=s response to NCVs. Accordingly, we will inform you as soon as we complete our evaluation of the Exelon response to our inspection report.

In accordance with 10 CFR 2.390 of the NRC's "Rules of Practice," a copy of this letter will be available electronically for public inspection in the NRC Public Document Room or from the Publicly Available Records System (PARS) component of NRC's Agencywide Documents Access and Management System (ADAMS), accessible from the NRC Web site at http://www.nrc.gov/reading-rm/adams.html (the Public Electronic Reading Room).
