MID-CYCLE PERFORMANCE REVIEW AND INSPECTION PLAN - INDIAN POINT NUCLEAR GENERATING UNITS 2 AND 3

Dear Mr. Dacimo:

On August 4, 2005, the NRC staff completed its performance review of the Indian Point Nuclear Generating Units 2 and 3 (IP2 and IP3) for the first half of the calendar year 2005 assessment cycle. Our technical staff reviewed performance indicators (PIs) for the most recent quarter and inspection results over the previous twelve months. The purpose of this letter is to inform you of our assessment of your safety performance during this period and our plans for future inspections at your facility.

This performance review and enclosed inspection plan do not include physical protection information. A separate letter designated and marked as Exempt from Public Disclosure in accordance with 10 CFR 2.390 will include the physical protection review and resultant inspection plan.

Plant performance at IP2 for the most recent quarter was within the Regulatory Response column of the NRCs Action Matrix based on a finding of low to moderate safety significance (White) in the Mitigating Systems cornerstone that involved degradation to the safety injection system over a period of several weeks. Specifically, the accumulation of nitrogen gas in portions of the safety injection system rendered one pump inoperable and would have degraded the performance of the two remaining pumps. In addition to baseline inspection activities to be conducted at IP2, a Supplemental Inspection will be conducted to provide assurance that Entergy's corrective actions for the degradation of the safety injection system are sufficient to address the root causes and contributing causes, and to prevent recurrence. This Supplemental Inspection is planned for the week of December 5, 2005.

Plant performance at IP3 for the most recent quarter was within the Licensee Response column of the NRCs Action Matrix, based on all inspection findings being classified as having very low safety significance (Green), and all PIs indicating performance at a level requiring no additional NRC oversight (Green). Therefore, we currently plan to conduct reactor oversight process (ROP) baseline inspections at IP3.

Mr. Fred Dacimo 2 Regarding the open substantive cross-cutting issue in the area of Problem Identification and Resolution (PI&R) at IP2, our annual assessment for 2004 noted weaknesses in corrective action as a common theme among inspection findings. We examined PI&R related findings from the last twelve months, including results from the June 2005 PI&R team inspection, and noted that Entergy reduced the number and significance of findings with the common theme of corrective action. However, there were also five findings that involved weaknesses in Entergy's evaluations for identified deficiencies, including the White finding for degradation of the safety injection system. These evaluations were not of sufficient rigor or quality to identify issues which subsequently contributed to a plant transient or degradation of safety equipment. We concluded that the PI&R cross-cutting issue should remain open. Entergy, through its self-assessments, has recognized the need to improve the rigor and quality of evaluations. The NRC will review the effectiveness of your improvement efforts through scheduled Baseline Inspections, and during a Supplemental Inspection scheduled for December.

The enclosed inspection plan details the inspections, less those related to physical protection scheduled through March 31, 2007. This inspection plan is provided to minimize the resource impact on your staff and to allow for the resolution of any scheduling conflicts and personnel availability issues well in advance of inspector arrival on site. Routine resident inspections are not listed due to their ongoing and continuous nature. The inspections in the last nine months of the inspection plan are tentative and may be revised at the end-of-cycle review.

In accordance with 10 CFR 2.390 of the NRCs Rules of Practice, a copy of this letter and its enclosure will be made available electronically for public inspection in the NRC Public Document Room or from the Publicly Available Records (PARS) component of NRC's document system (ADAMS).
