HOPE CREEK GENERATING STATION, FACSIMILE TRANSMISSION, DRAFT REQUEST FOR ADDITIONAL INFORMATION (RAI) TO BE DISCUSSED IN AN UPCOMING CONFERENCE CALL (TAC NO. MC4987)

The attached draft RAI was transmitted by facsimile on November 5, 2004, to Mr. Michael Mosier, PSEG Nuclear, LLC (PSEG). This draft RAI was transmitted to facilitate the technical review being conducted by the staff and to support a conference call with PSEG in order to clarify certain items in the licensees submittal. This draft RAI is related to PSEGs submittal dated October 29, 2004, regarding a request for NRC approval to update the American Society of Mechanical Engineers Boiler and Pressure Vessel Code,Section XI, Code of Reference for the Hope Creek Generating Station to the 1998 Edition with 2000 Addenda.

Review of the RAI would allow PSEG to determine and agree upon a schedule to respond to the RAI. This memorandum and the attachment do not convey a formal request for information or represent an NRC staff position.

DRAFT REQUEST FOR ADDITIONAL INFORMATION REGARDING AMENDMENT REQUEST TO UTILIZE ARTS/MELLLA OPERATING DOMAIN HOPE CREEK GENERATING STATION DOCKET NO. 50-354 By letter dated October 29, 2004, PSEG Nuclear, LLC (PSEG) submitted a letter seeking U.S.

Nuclear Regulatory Commission approval to update the American Society of Mechanical Engineers Boiler and Pressure Vessel (ASME) Code,Section XI, Code of Reference for the Hope Creek Generating Station to the 1998 Edition with 2000 Addenda. The NRC has developed the following draft questions during its review of the application:

1. In accordance with Federal Register Notice 69 FR 58804, licensees using the 1998 Edition with 2000 Addenda of Section XI of the ASME Code are required, among other things, to comply with the following:

a) Paragraph IWA-4340 of the 2000 Addenda regarding mitigation of defects by modification will not be used.

b) The repair and replacement activity provisions in IWA-4540(c) of the 1998 Edition,Section XI for pressure testing Class 1, 2, and 3 mechanical joints will be applied when using the 1998 Edition through the 2000 Addenda of Section XI of the ASME Code.

Please confirm that these limitations will be complied with.
