Section IV of the subject Order states that, in accordance with 10 CFR §2.202, a licensee must submit an answer to the Order and may request-a hearing on the-Order within 20 days of the date thereof. This letter constitutes the answer (pursuant to 10 CFR 2.202 and Section IV) and response (pursuant to 10 CFR 50.4 and Sections III A.1, B.1 and B.2) of the Tennessee Valley Authority (TVA) to the Order.

TVA consents to the Order, and does not request a hearing.

On January 27, 2003, TVA responded to the January 7, 2003, Issuance of Order for Compensatory Measures Related to Access Authorization for power reactors for BFN, Units 1, 2, and 3; SQN, Units 1 and 2; and Watts Bar Nuclear Plant, Unit 1. One year later, by letter dated January 7, 2004, TVA confirmed full compliance with the January 7, 2003, Access Authorization Order.

46 U.S. Nuclear Regulatory Commission Page 2 September 7, 2004 Because the Independent Spent Fuel Storage Installations are located within the protected area at the same site as the power reactors at BFN and SQN, TVA intends to apply the measures instituted for the January 7, 2003, Access Authorization Order as the method of compliance for this Order.
