Dear Mr. Nazar:

This letter refers to an investigation conducted by the U.S. Nuclear Regulatory Commission (NRC), Region III (RIII), Office of Investigations (OI) to determine if a former contract engineer was discriminated against for raising safety issues related to the corrective actions program, overtime, and the quality of procedures. Based on the evidence developed during the investigation, we did not substantiate this issue. The OI investigation synopsis is enclosed. In accordance with 10 CFR 2.790 of the NRCs "Rules of Practice," a copy of this letter, its enclosure, and your response, if any, will be available electronically for public inspection in the NRC Public Document Room or from the Publicly Available Records (PARS) component of NRCs document system (ADAMS). SYNOPSIS On October 22, 2001, an Allegation Review Board requested that the Region III, Office of Investigations (OI) initiate an investigation to determine whether D.C. Cook Management deliberately discriminated against a contract engineer for raising safety concerns in violation of 10 CFR 50.5 and 50.7.

Based on the evidence developed, this investigation did not substantiate that a contract engineer was discriminated against for raising nuclear quality assurance concerns and/or safety concerns.
